What to prepare when your proposed company has no director resident in the European Economic Area. Use this guide to prepare your questions and information before applying.
Check residency before choosing a package
A founder’s citizenship is not the test. Confirm where all proposed directors actually reside. The EEA includes EU member states, Iceland, Liechtenstein and Norway. The United Kingdom is not part of the EEA.
The bond route
A Section 137 bond provides the alternative specified in company law when the residency condition is not met. Our Non-Resident package includes a two-year bond alongside incorporation and the listed compliance services.
An exemption is not automatic
A company may qualify for a certificate based on a real and continuous link with economic activity in Ireland. Do not assume that having customers, an address or an incorporation certificate is enough. Ask an adviser about eligibility.
Keep the position under review
Director changes and the expiry of a bond can affect compliance. Plan ahead before the end of the coverage period. We can help identify the formation route, but approval and exemptions rest with the relevant authorities.
